Finally a decision on UK refarming

The release of the 2.6 Ghz and digital dividend bands in the UK has been consulted on for the past four years and under discussion for much longer so the long-awaited arrival of a legislative framework to auction these bands at the end of 2011 is certainly welcome.

The majority enjoyed by the new coalition government means political approval is likely but the real question is whether the new proposals will survive the scrutiny of the courts. 

Unlike the previous plan there are no spectrum caps to even out the distribution of frequencies among operators, although Ofcom is required to design the auctions based on an assessment of the impact on competition. The issue now is the reaction of market players, most of whom are weighing their options until the holiday season is over.
